OVERVIEW

Welcome to SnowFlux.

The terms “SnowFlux,” “we,” “us,” and “our” refer to the business operating this website and online store.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, content, features, and related services (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce technology that enables us to offer our products and Services to you.

By accessing our website, using our Services, or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies that cannot legally be excluded under the consumer protection laws applicable to you. If applicable mandatory law gives you greater rights than these Terms, those legal rights will prevail.


SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must have the legal capacity to enter into a binding contract in your country or jurisdiction to make purchases through our store.

If you are under the legal age required to enter into a contract, you may use the Services or make purchases only with the involvement and authorization of a parent or legal guardian where required by applicable law.

Product images may include lifestyle photography or illustrative representations. Unless otherwise stated, accessories or items shown alongside the principal product are not necessarily included.

We may update product descriptions, specifications, availability, and other information where reasonably necessary.

We may discontinue products or limit quantities available for purchase, subject to applicable law.

Nothing in this section limits your legal rights regarding products that are faulty, unsafe, materially misdescribed, or otherwise non-conforming.


SECTION 3 — ORDERS AND CONTRACT FORMATION

By submitting an order, you make an offer to purchase the products included in that order.

After placing an order, you may receive an automatic order acknowledgement. Unless expressly stated otherwise, an automatic acknowledgement merely confirms that we have received your order and does not necessarily mean that the order has been accepted.

A binding purchase contract is formed when we confirm acceptance of your order or dispatch the relevant products, depending on the checkout process and applicable law.

We reserve the right to decline or cancel an order where reasonably necessary, including in cases involving:

  • Product unavailability.

  • Suspected fraud or unauthorized transactions.

  • Incorrect or incomplete customer information.

  • Restrictions on delivery to a particular location.

  • Manifest pricing or product information errors.

  • Violation of these Terms.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method as required by applicable law.

Nothing in this section affects any cancellation or withdrawal rights provided by law.


SECTION 4 — ORDER CHANGES AND CANCELLATIONS

We cannot guarantee that an order can be modified or cancelled once it has entered processing or has been dispatched.

This does not affect any statutory cancellation, withdrawal, return, refund, or consumer rights that apply to your purchase.


SECTION 5 — PRICES, CURRENCY AND PAYMENT

Prices displayed on our website may be shown in different currencies depending on your location or selected market.

The final amount payable will be displayed during checkout before you submit your order.

Prices and promotions may change from time to time. Changes will not normally affect orders that have already been accepted, except where permitted or required by applicable law.

Where applicable, taxes may be included in the displayed price or calculated during checkout.

International orders may also be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.

Where these amounts are not collected by us at checkout, the customer may be responsible for paying them to the relevant authority, carrier, or customs agent.

We are not responsible for independently imposed customs duties or taxes except where applicable law requires otherwise or where we expressly state that such charges are included.

You agree to provide valid and authorized payment information.

Payment processing may be carried out by third-party payment providers and may be subject to their respective terms and conditions.


SECTION 6 — PRICING AND WEBSITE ERRORS

We make reasonable efforts to ensure that pricing and product information is accurate.

Occasionally, an obvious typographical, technical, pricing, promotional, stock, or other error may occur.

Where permitted by applicable law, we may correct such errors.

If a manifest pricing or product error affects an order, we may contact you before fulfilling the order and offer you the opportunity to proceed at the correct price or cancel the order.

If an affected order is cancelled after payment has been collected, the corresponding amount will be refunded.

We will not rely on this provision to unfairly cancel valid orders or deprive consumers of mandatory legal rights.


SECTION 7 — SHIPPING AND DELIVERY

Delivery times displayed on our website are estimates unless we expressly state that a particular delivery date is guaranteed.

Delivery may be affected by circumstances outside our reasonable control, including customs procedures, carrier delays, weather conditions, transportation disruptions, natural events, or other events beyond our control.

We will nevertheless comply with any mandatory delivery obligations imposed by applicable consumer law.

Risk of loss or damage to products will transfer to you only at the time required by applicable law.

Where applicable consumer law provides that we remain responsible for an order until you, or a person designated by you, physically receives the goods, those protections will apply.

SECTION 8 — INTERNATIONAL ORDERS

SnowFlux may sell and ship products to customers in multiple countries and regions.

Availability, delivery methods, delivery times, prices, taxes, customs procedures, and product availability may vary by destination.

You are responsible for ensuring that products you purchase can legally be imported into and used in your country, except to the extent that applicable law places that responsibility on us.

We may be unable to deliver certain products to particular countries or regions because of carrier, regulatory, customs, sanctions, or other legal restrictions.


SECTION 9 — RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, and exchanges are governed by our Return & Refund Policy.

SnowFlux provides a voluntary 30-day return policy, subject to the terms stated in that policy.

This commercial return policy is provided in addition to, and does not replace or restrict, any mandatory consumer rights available under applicable law.

Consumers may have additional rights relating to defective, damaged, misdescribed, unsafe, or non-conforming products, and those rights may continue beyond the voluntary 30-day return period.


SECTION 10 — CONSUMER RIGHTS

Nothing in these Terms limits or excludes any consumer guarantee, warranty, remedy, statutory right, cancellation right, withdrawal right, or other protection that cannot lawfully be limited or excluded.

Depending on your country or region, these rights may include rights relating to:

  • Goods being of satisfactory or acceptable quality.

  • Goods being fit for their normal or stated purpose.

  • Goods corresponding with their description.

  • Repair, replacement, refund, price reduction, or other remedies for defective goods.

  • Cancellation or withdrawal from certain distance or online contracts.

  • Protection against unfair contractual terms.

Where these Terms conflict with a mandatory consumer protection law applicable to your purchase, the mandatory law will prevail.


SECTION 11 — EUROPEAN UNION AND EEA CONSUMERS

If you are a consumer located in the European Union or European Economic Area and applicable EU consumer legislation applies to your purchase, you retain all mandatory rights provided under such legislation.

For eligible distance purchases, this generally includes a statutory right to withdraw from the contract within 14 days without giving a reason, subject to applicable exceptions.

Our voluntary 30-day return policy is separate from and additional to this statutory right.

Nothing in these Terms restricts any mandatory legal guarantee or remedy available to consumers under applicable EU or national consumer law.


SECTION 12 — UNITED KINGDOM CONSUMERS

Consumers in the United Kingdom retain all mandatory rights provided under applicable UK consumer legislation.

Nothing in these Terms is intended to limit rights relating to goods that are faulty, not as described, of unsatisfactory quality, or unfit for purpose.

Where applicable, statutory cancellation rights for online purchases will also continue to apply independently of our voluntary return policy.


SECTION 13 — AUSTRALIAN CONSUMERS

If Australian Consumer Law applies to your purchase, nothing in these Terms excludes, restricts, or modifies consumer guarantees, rights, or remedies that cannot lawfully be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Where required by Australian Consumer Law, consumers may be entitled to remedies including repair, replacement, refund, or compensation depending on the nature and seriousness of the problem.

Our voluntary policies operate in addition to these rights.


SECTION 14 — INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content, including our brand name, logos, graphics, designs, photographs, videos, text, website layout, and other materials, are owned by or licensed to SnowFlux and are protected by applicable intellectual property laws.

You may access and use the website for personal and lawful purposes.

Except where permitted by law, you may not reproduce, distribute, modify, publish, commercially exploit, sell, license, scrape, or create derivative works from our proprietary content without our prior authorization.

Third-party trademarks, photographs, content, software, and other intellectual property remain the property of their respective owners.

Nothing in these Terms transfers ownership of any intellectual property rights to you.


SECTION 15 — REVIEWS AND USER CONTENT

If you submit a product review, photograph, video, comment, suggestion, or other content to SnowFlux (“User Content”), you represent that you have the rights necessary to submit that content.

You retain ownership of your User Content.

By voluntarily submitting User Content to us, you grant SnowFlux a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt, and use that content to operate, improve, market, and promote our business and Services, subject to applicable law.

You must not submit content that:

  • Infringes another person's intellectual property or privacy rights.

  • Is unlawful, fraudulent, defamatory, threatening, or abusive.

  • Contains malware or harmful computer code.

  • Misrepresents its origin or authenticity.

Where required by applicable law, sponsored, incentivized, or compensated reviews must be appropriately disclosed.

We may remove User Content where we reasonably believe it violates these Terms or applicable law.


SECTION 16 — ACCEPTABLE USE

You must not use the Services:

  • For unlawful or fraudulent purposes.

  • To infringe the rights of another person.

  • To distribute malware or malicious code.

  • To gain unauthorized access to systems, accounts, or information.

SECTION 18 — SHOPIFY

Our store is hosted using Shopify's ecommerce platform.

Shopify provides technology that enables us to operate the online store, but purchases made from SnowFlux are transactions between you and SnowFlux, not Shopify.

Shopify may process certain personal information and provide technological, payment, security, or other infrastructure supporting our store.

The processing of personal information is further described in our Privacy Policy and, where applicable, Shopify's own privacy documentation.


SECTION 19 — PRIVACY

The collection and processing of personal information through our Services is governed by our Privacy Policy.

Our Privacy Policy explains, among other things:

  • What information we collect.

  • With whom it may be shared.

  • Data retention.

  • Your privacy rights.

We do not guarantee that our website will always be available without interruption or technical errors.

However, nothing in these Terms excludes or limits any statutory guarantee, implied warranty, product warranty, or consumer right that cannot legally be excluded.

In particular, nothing in these Terms is intended to exclude our obligations regarding products that are defective, unsafe, materially misdescribed, or otherwise fail to comply with applicable consumer law.


SECTION 22 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or limit liability for:

  • Fraud or fraudulent misrepresentation.

  • Death or personal injury where liability cannot legally be excluded.

  • Gross negligence or intentional misconduct where applicable law prohibits such exclusion.

  • Breach of mandatory consumer rights.

  • Any other liability that cannot lawfully be excluded or restricted.

Subject to the above and to the maximum extent permitted by applicable law, SnowFlux will not be responsible for losses that are not reasonably foreseeable consequences of our breach or that result from circumstances outside our reasonable control.

If you purchase products as a consumer, nothing in these Terms affects the remedies available to you under mandatory consumer protection legislation.


SECTION 23 — EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delay or failure to perform an obligation where the delay or failure results from an event outside our reasonable control, to the extent permitted by applicable law.

Such events may include natural disasters, severe weather, war, civil unrest, government action, transportation disruptions, widespread telecommunications failures, customs delays, epidemics, labor disruptions, or similar circumstances.

If such an event materially affects an order, we will take reasonable steps to inform you and minimize the impact where practicable.

Your statutory rights remain unaffected.


SECTION 24 — SUSPENSION AND TERMINATION

We may suspend or terminate access to an account or the Services where reasonably necessary, including where:

  • These Terms have been materially violated.

  • Fraudulent activity is reasonably suspected.

  • Security of the Services is threatened.

  • Continued access would violate applicable law.

Termination of access to the website does not remove rights or obligations that arose before termination, including payment obligations, refund rights, consumer rights, intellectual property rights, and provisions that by their nature are intended to survive termination.


SECTION 25 — GOVERNING LAW

These Terms and any contract between you and SnowFlux will be governed by the laws applicable to the business operating SnowFlux, subject always to any mandatory consumer protection laws that apply to you.

If SnowFlux is operated from Spain, these Terms may be governed by the laws of Spain.

However, if you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of habitual residence where those protections cannot legally be waived.


SECTION 26 — DISPUTES AND JURISDICTION

We encourage customers to contact us first at snowflux.info@gmail.com so that we can attempt to resolve any dispute directly.

Nothing in these Terms prevents a consumer from bringing a claim before a court or authority where they are legally entitled to do so under mandatory consumer protection rules.

Where the law allows the parties to agree on jurisdiction and no mandatory consumer jurisdiction rule applies, disputes may be submitted to the courts having jurisdiction over the place where the business operating SnowFlux is established.

We do not require consumers to waive a mandatory right to bring proceedings in their country or place of residence where applicable law gives them that right.


SECTION 27 — SEVERABILITY

If any provision of these Terms is determined by a competent court or authority to be illegal, invalid, or unenforceable, that provision will apply only to the maximum extent permitted by law.

Where possible, the remaining provisions will continue in full force and effect.

If we do not immediately exercise a right or remedy under these Terms, this does not mean that we waive that right or remedy.

Any waiver must comply with applicable law.

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other legitimate reasons.

The most current version will be available on this page.

Where required by applicable law, we will provide appropriate notice of material changes.

Changes to these Terms will not retroactively remove rights that you have already acquired under an existing purchase or contract.


SECTION 30 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other terms expressly incorporated into your purchase, constitute the agreement governing your use of the Services and purchases from SnowFlux.

Nothing in this provision excludes representations or rights that cannot legally be excluded.
